These Terms and Conditions govern your use of the Elements|ED online learning environment (the "Site"), as provided by NextPoint Training, Inc. ("Company," "We," or "Us"). The Basics

The Site provides module-based resources that supplement instructor-led courses, certification programs, online learning, self-study, and similar structured learning efforts.

We reserve the right to change, suspend, or discontinue any aspect of the Site at any time. We may also impose limits on certain features or restrict access for any user without notice.

User Conduct and Usage Restrictions

You warrant and agree that you shall not: (a) impersonate or represent another person, entity, business, or school; (b) use, distribute, or exploit any functionality, information, or data obtained from the Site for commercial purposes; or (c) harvest, collect, or store information about the Users or content of this Site.

Claims Against Company

You agree to defend, indemnify, and hold harmless the Company, its directors, officers, employees, agents, and affiliates from any and all claims, liabilities, costs, and expenses arising in any way from your use of the Site.

You acknowledge that Company is the owner of all content appearing on the Site. Use of the Site does not grant you rights to any content or materials you may access on the Site.

Elements|ED Developers. NextPoint Training, Inc. uses certain trusted third parties (for example, web developers and content creators) to help improve, expand, and promote the Services on the Elements|ED platform. Third-party use of private information will comply with this Privacy Policy.
Other Users. Our Services may display information such as your name and email address to other users, including instructors using the Elements|ED platform. We allow instructors to find you by making some of your basic account information searchable. This helps instructors create a class roster without making duplicate accounts for existing Elements users.
Other Applications. You may have occasion to grant third parties access to your information and account – for example, via Elements APIs. Third party use of your information will be governed by their privacy policies and terms.
Law Enforcement. We may disclose your information to law enforcement if we determine that such disclosure is reasonably necessary to (a) comply with the law; (b) protect any person from death or serious bodily injury; (c) prevent fraud or abuse; or (d) protect our property rights.

However, some delay may be incurred in deleting information from our servers and back-up storage.
